Retail theft, as defined in 720 ILCS 5/16-25, is either a misdemeanor or a felony depending on the total value of the property that was shoplifted. The penalties are as follows:
Theft of Property Worth $300 or less:
- Class A misdemeanor
- Fine of up to $2,500
- Imprisonment for up to 1 year
Theft or Property Worth More than $300:
- Class 3 felony
- Fine of up to $25,000
- Imprisonment for 2-5 years
